These Terms of Service ("Terms") govern your use of Aoibh's website and creative services, operated by Aoibh Studio ("Aoibh," "we," "us," or "our"), a company registered in the United Kingdom with its registered office at 36 Woodville Road, London, N16 8NA, United Kingdom. By starting a brief, subscribing to a plan, or otherwise using our services, you agree to these Terms.
1. Who these Terms apply to
Aoibh's services are intended for businesses and professionals commissioning creative work, not individual consumers acting outside a trade or profession. By using our services you confirm you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the organization you represent.
2. What we provide
Aoibh provides design and creative production services — including brand identity, motion and video, product and web design, packaging, and related disciplines — delivered through a combination of AI-assisted drafting and human designers matched to your brief, with every delivery reviewed by a human art director before it ships.
Our services cover design work. Work requiring functionality — ecommerce integration, custom software development, backend logic — falls outside the scope of any plan and is quoted separately, where we're able to accommodate it at all.
3. Plans and one-off projects
We offer subscription plans (currently Starter, Growth, and Enterprise) billed monthly, and a one-off Trial Project for new clients. Current pricing, inclusions, and limits for each are published on our pricing page and form part of these Terms by reference. We may change our published pricing and plan inclusions at any time; changes will not affect a billing period you've already paid for.
3.1 What counts as one project
A project is a single deliverable — one logo, one set of brand guidelines, one packaging concept, one landing page, and so on. Multi-part work, such as a full identity system spanning several deliverables, is scoped and quoted separately rather than treated as a single project.
3.2 Revisions
Each project includes a set number of revision rounds, as stated on our pricing page for your plan. Additional rounds beyond that limit can be added to a project on request, at an additional cost.
4. Billing and cancellation
Subscriptions are billed in advance on a monthly basis and renew automatically until cancelled. You may cancel at any time ahead of your next billing date; your subscription remains active, and you retain access to your plan's benefits, through the end of the period you've already paid for. We do not provide refunds for partial billing periods except where required by applicable law.
Payments are processed securely by Stripe. Published prices are shown exclusive of VAT; where VAT applies, it is calculated and added at checkout based on your location and the applicable rate.
5. Your content and intellectual property
5.1 What you give us
You may upload logos, brand guidelines, footage, or other reference material as part of a brief. You confirm you have the right to share this material with us and grant us the right to use it solely to deliver the project it was submitted for.
5.2 What we deliver
Upon full payment for a project, ownership of the final, approved deliverables transfers to you, except for any pre-existing assets, tools, or techniques we or our designers already owned and any third-party licensed material (such as stock assets), which remain licensed for your use as delivered but not owned by you.
5.3 Portfolio use
Unless you tell us otherwise in writing, we and the designer who worked on your project may display the finished work in our respective portfolios, including on this website, for promotional purposes. This defaults the other way for clients on a white-label Enterprise plan: we will not feature your work in our portfolio, or otherwise reference having worked with you, unless you opt in and tell us so in writing.
6. AI-assisted work
Our process uses generative AI for first-pass drafts, variations, and automated quality checks, alongside human designers and art directors who are responsible for the creative direction and final review of every deliverable. By using our services, you acknowledge that AI tools are part of how your work is produced.
7. Acceptable use
You agree not to submit briefs for content that is unlawful, infringes a third party's rights, or that we reasonably believe is intended to harass, deceive, or harm others. We may decline or discontinue work on a project on this basis, with a good-faith effort to explain why.
8. Warranties and limitation of liability
We aim to deliver work that reasonably reflects your brief, on the timelines stated in your plan. We do not guarantee that any deliverable will achieve a particular business outcome (such as sales, engagement, or brand recognition). To the maximum extent permitted by law, our total liability arising from these Terms or your use of our services is limited to the amount you paid us in the three (3) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
9. Termination
Either party may terminate a subscription as described in Section 4. We may suspend or terminate your access immediately if you breach these Terms, including under Section 7.
10. Changes to these Terms
We may update these Terms from time to time. We'll post the updated version here with a new "last edited" date; continued use of our services after an update constitutes acceptance of the revised Terms.
11. Governing law
These Terms are governed by the laws of the United Kingdom, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
